At The CARE App Inc., including its wholly-ownedsubsidiaries, (collectively "CARE," "us,""we," or "our"), our mission is to unlockhuman care and extend healthspan through personalized data insights. We existto improve your life, not invade it. This should be the standard for allcompanies providing wearable devices and health technology. We take yourprivacy seriously and want you to understand how we use, collect, and sharePersonal Data and the measures we take to protect your Personal Data."Personal Data" means any information that identifies you or can bereasonably linked to you, or information which is otherwise considered to be"personal information" or "personal data" under applicablelaws.

This Privacy Policy applies to Personal Data we collectabout CARE members and other consumers who interact with CARE or use ourservices, including by visiting our websites or our social media pages or byusing our mobile apps, or any features, content, or applications offered byCARE in connection therewith (collectively, the "Services").This Privacy Policy does not cover the practices of companies or people that wedo not own, control or manage. We are not responsible for the policies andpractices of any third parties, and we do not control, operate, or endorse anyinformation, products, or services that may be offered by third parties oraccessible on or through the Services. For clarity, we are responsible for thedata protection practices of our data processors (i.e., those processingPersonal Data of which we are the controllers in relation to the Services) inaccordance with the data protection laws applicable to the jurisdiction inwhich you reside.

Consumer Health Data Privacy Notice. In connectionwith the Services, CARE may process health-related data that constitutes"Consumer Health Data," as defined by applicable US state laws. How we collect and use (process) your personalinformation

The Care App Inc collects personal information about itswebsite visitors and customers. With a few exceptions, this information isgenerally limited to:

·       You,when you provide such information directly to us, such as when completing yourprofile, responding to a questionnaire, or communicating with us directlythrough customer support;

·       Automatic data collection, such as Cookies, local storage objects, web beacons,and other similar technologies in connection with your use of the Services;

·       Customers and partners, such as employers, insurance companies, coaches, teams,or other organizations that engage with our Services;

·       Marketing and advertising partners, such as companies that have entered in jointmarketing relationships with us or assist us with marketing or promotionalservices;

·       Social media, other third-party platforms, and linked accounts, devices, orfeatures, if you interact with our pages on social media sites; and

·       Data providers, such as information services and data licensors, when wesupplement your data.

We use this information to provide prospects and customerswith services.

We do not sell personal information to anyone and only shareit with third parties who are facilitating the delivery of our services.

From time to time, The Care App Inc receives personalinformation about individuals from third parties. Typically, informationcollected from third parties will include further details on your employer orindustry. We may also collect your personal data from a third party website(e.g. LinkedIn)

We may collect the following types of Personal Data:

  • Contact details, such as your first and last name, email and mailing address,     and phone number;
  • Profile data, such as username and password that you may establish to create a     CARE account, as well as any photographs or information you choose to     include in your CARE profile;
  • Communications     that we exchange with you, including when you contact us via email, web     app, or mobile app with questions, feedback, or reviews;
  • Wellness data, including but not limited to physiological metrics such as     resting heart rate, heart rate variability, respiratory rate, skin temperature and blood oxygen saturation level; acceleration; metadata on workouts and sleep; the type of physical activity you engage in and the     duration of your activity; data reflecting fitness and recovery; your     physiological profile, including birthday, gender identity, weight,     height, fitness/athlete level; and details you choose to submit about your  habits, diet, medications, and female health tracking.
  • Consumer health data, including but not limited to biomarkers, other health metrics. We do not use your consumer health data for marketing purposes, nor do we sell such data to third parties.
  • Conversations     that you participate in with the CARE Coach, as described in Section 8     below;
  • Payment     and transactional data needed to complete your orders on the website     or through the Services (including name, email address, payment card     information, billing information). CARE does not have access to full     payment card numbers; our processors handle this in accordance with their     own policies;
  • Marketing     data, such as your preferences for receiving our marketing     communications and details about your engagement with them;
  • Device     data, such as your computer or mobile device operating system type and     version, manufacturer and model, browser type, screen resolution, IP     Address, unique identifiers, and general location information;
  • Geolocation     data, such as GPS (precise geolocation), IP Address, and movement on     certain exercise types if you give permission; and
  • Online     activity data, such as pages or screens you view, how long you spent     on a page, and navigation paths.

Health and Fitness Metrics

In order to provide our core Services, CARE collects andprocesses specific physiological and activity data. This information is typically gathered via your connected CARE device or through integrations with health platforms such as Apple Health (iOS) or Health Connect (Android).

Specific Data Types Collected:

  • Activity & Performance: Exercise sessions and workouts (including type and     duration), step count, and VO2 Max.
  • Physiological & Vital Signs: Heart rate (real-time), heart rate variability     (HRV), resting heart rate (RHR), and respiratory rate.
  • Rest & Recovery: Detailed sleep data, including sleep stages, duration,     and disturbances.
  • iOS Specific Metrics: For users on iOS devices, we request access to two     additional fields to accurately categorize and calculate the intensity of     various exercise types:
       
    • Distance: Used for distance-based activities like running, cycling, or swimming.
      •  
    • Active Energy Burned: Used to calculate metabolic demands and calorie      expenditure.

How We Use This Data

We use the metrics listed above to power the CARE "engine" and provide you with actionable health data. Specifically:

  • Score     Calculation: We process these metrics through proprietary algorithms     to generate your daily "Fitness" "Strain," and     "Sleep" scores.
  • Personalized     Content and Insights: Your data allows the CARE Coach and our platform     to provide suggestions tailored to your current physiological state (e.g.,     suggesting a rest day if your HRV is low).
  • General     Tracking and Trends: We provide longitudinal analysis so you can     monitor your health progress, fitness improvements, and physiological     changes over weeks, months, and years.
  • Research     & Product Improvement: We use de-identified versions of this data     to improve our algorithm accuracy and develop new wellness features.

Access and Permissions

You have total control over what data CARE can access.

  • Granting/Revoking     Access: You can grant or revoke CARE’s access to these data points at     any time through your mobile device’s system settings (e.g., via the     Health app on iOS or the CARE app settings).
  • Impact     of Revocation: Please note that if you revoke access to specific     metrics (such as heart rate or sleep data), CARE will be unable to     calculate your scores or provide personalized health insights, as these     calculations require a continuous stream of data.

Use of The Care App Inc Website

As is true of most other websites, The Care App Inc’s website collects certain information automatically and stores it in log files.The information may include internet protocol (IP) addresses, the region orgeneral location where your computer or device is accessing the internet,browser type, operating system and other usage information about the use of The Care App Inc’s website, including a history of the pages you view. We use thisinformation to help us design our site to better suit our users’ needs. We mayalso use your IP address to help diagnose problems with our server and toadminister our website, analyze trends, track visitor movements, and gatherbroad demographic information that assists us in identifying visitorpreferences.

The Care App Inc has a legitimate interest in understanding how members, customers and potential customers use its website. This assistsThe Care App Inc with providing more relevant products and services, with communicating value to our sponsors and corporate members, and with providingappropriate staffing to meet member and customer needs.

Cookies and tracking technologies
CARE uses cookies and similar technologies (collectively, "Cookies")to enable our servers to recognize your web browser and tell us how and whenyou visit and use our Services. If you live in Europe, we will obtain your (opt-in) consent prior to deploying any cookies other than "strictlynecessary" ones.

Cookie Usage and Type:

  • Essential     Cookies: Required for providing you with features or Services that you     have requested, such as secure login.
  • Functionality     Cookies: Used to record your choices and settings, maintaining your     preferences over time.
  • Performance/Analytical     Cookies: Allow us to understand how users use our Services and measure     the performance of our advertising campaigns.
  • Marketing     Cookies: Collect data about your online activity to identify your     interests and provide relevant marketing.

Online tracking opt-outs: Users can block cookies intheir browsers, block advertising ID use in mobile settings, or use privacyplug-ins like Privacy Badger or uBlock Origin. We also supportplatform-specific opt-outs for Google, Microsoft, and Facebook.

 

Sharing information with third parties

The personal information The Care App Inc collects from youis stored in one or more databases hosted by third parties located in theUnited States. These third parties do not use or have access to your personalinformation for any purpose other than cloud storage and retrieval. Onoccasion, The Care App Inc engages third parties to send information to you,including information about our products, services, and events.

We do not otherwise reveal your personal data to non-TheCare App Inc persons or businesses for their independent use unless: (1) you request or authorize it; (2) it’s in connection with The Care App Inc-hostedand The Care App Inc co-sponsored conferences as described above; (3) theinformation is provided to comply with the law (for example, compelled by law enforcement to comply with a search warrant, subpoena, or court order), enforcean agreement we have with you, or to protect our rights, property or safety, orthe rights, property or safety of our employees or others; (4) the information is provided to our agents, vendors or service providers who perform functionson our behalf; (5) to address emergencies or acts of God; or (6) to address disputes, claims, or to persons demonstrating legal authority to act on yourbehalf. We may also gather aggregated data about our services and websitevisitors and disclose the results of such aggregated (but not personally identifiable) information to our partners, service providers, advertisers,and/or other third parties for marketing or promotional purposes.

The Care App Inc website connects with third party servicessuch as Facebook, LinkedIn, Twitter and others. If you choose to share information from The Care App Inc website through these services, you shouldreview the privacy policy of that service. If you are a member of a third partyservice, the aforementioned connections may allow that service to connect yourvisit to our site to your personal data.

 

Transferring personal data to the U.S.

The Care App Inc has its headquarters in the United States. Information we collect about you will be processed in the United States. Byusing The Care App Inc’s services, you acknowledge that your personalinformation will be processed in the United States. The United States has notsought nor received a finding of “adequacy” from the European Union underArticle 45 of the GDPR. Pursuant to Article 46 of the GDPR, The Care App Inc isproviding for appropriate safeguards by entering binding, standard dataprotection clauses, enforceable by data subjects in the EEA and the UK. Theseclauses have been enhanced based on the guidance of the European DataProtection Board and will be updated when the new draft model clauses areapproved.

Depending on the circumstance, The Care App Inc alsocollects and transfers to the U.S. personal data with consent; to perform acontract with you; or to fulfill a compelling legitimate interest of The CareApp Inc in a manner that does not outweigh your rights and freedoms. The CareApp Inc endeavors to apply suitable safeguards to protect the privacy andsecurity of your personal data and to use it only consistent with your relationship with The Care App Inc and the practices described in this Privacy Statement. The Care App Inc also enters into data processing agreements andmodel clauses with its vendors whenever feasible and appropriate. Since it wasfounded, The Care App Inc has received zero government requests forinformation.

Data Subject rights

The European Union’s General Data Protection Regulation(GDPR) and other countries’ privacy laws provide certain rights for datasubjects. Data Subject rights under GDPR include the following:

You may also request information about: the purpose of the processing; the categories of personal data concerned; who else outside TheCare App Inc might have received the data from The Care App Inc; what thesource of the information was (if you didn’t provide it directly to The CareApp Inc); and how long it will be stored. You have a right to correct (rectify)the record of your personal data maintained by The Care App Inc if it is inaccurate. You may request that The Care App Inc erase that data or ceaseprocessing it, subject to certain exceptions. You may also request that TheCare App Inc cease using your data for direct marketing purposes. In manycountries, you have a right to lodge a complaint with the appropriate dataprotection authority if you have concerns about how The Care App Inc processesyour personal data. When technically feasible, The Care App Inc will—at your request—provide your personal data to you.

Reasonable access to your personal data will be provided at no cost. If access cannot be provided within a reasonable time frame, The Care App Inc will provide you with a date when the information will be provided. If for some reason access is denied, The Care App Inc will provide an explanationas to why access has been denied.

Data storage and retention

Your personal data is stored by The Care App Inc on itsservers, and on the servers of the cloud-based database management services The Care App Inc engages, located in the United States. The Care App Inc retains service data for the duration of the customer’s business relationship with TheCare App Inc and for a period of time thereafter, to analyze the data for TheCare App Inc’s own operations, and for historical and archiving purposes associated with The Care App Inc’s services. The Care App Inc retains prospectdata until such time as it no longer has business value and is purged from TheCare App Inc systems. All personal data that The Care App Inc controls may bedeleted upon verified request from Data Subjects or their authorized agents.

We employ physical, technical, and administrative security measures to protect your data. However, no measures are fail safe. We retain Personal Data for as long as reasonably necessary for business purposes or asrequired by law.

Deleting Your PersonalData

You maintain full control over your personal data and have the right to remove all of your information from The Care App at any time.

We offer two distinct methods for initiating the permanentdeletion of your data:

1. In-App Data Removal (Recommended)

The most direct way to remove your data is by using the dedicated deletion feature available within the application settings. This process immediately initiates the permanent removal of all associated accountdata from our services.

2. Requesting Deletion via Support

If you require assistance or prefer to submit a formalrequest for data removal, you may contact us directly via email at support@thecare.app.

Upon receiving a verified request for the removal of all your personal data through this support channel, we commit to processing and confirming the complete deletion of your information within 10 days ofreceipt. Once processed, the data is permanently erased and cannot berecovered.

 

Children’s data

We do not knowingly attempt to solicit or receiveinformation from children. If we learn that we have collected Personal Datafrom a child under the age to consent to data sharing in their jurisdiction, wewill delete that information as quickly as possible.
